TERMS AND CONDITIONS

(The following Terms and Conditions, Travel Acknowledgment and Waiver were updated and are in effect as of October 1st, 2020)

1. RESERVATION, PRICE AND PAYMENT

1.1 Reservation

When you register for one of our tours, you accept our Terms and Conditions, Travel Acknowledgement and Waiver. The reservation will be confirmed depending on the availability of the chosen tour. The reservation will be definitive upon the payment of the requested deposit with the completed online registration form and acceptance of the Terms & Conditions.

1.2 Price

All prices are quoted in your local currency unless stated otherwise. We reserve the right to not provide a breakdown of costs or an itemized list. Price is calculated using rates and tariffs in place as of the date of your quote.

The customer acknowledges that the price of the contract could be modified following a fuel surcharge or an increase in the currency exchange rate. In this event, if the modification results in an increase of the price of less than 7%, excluding GST and PST, the client undertakes to pay the difference and, if the modification results in an increase of the price of 7% or more, excluding GST and PST, the client may choose to cancel the contract with full reimbursement or accept the provision of similar services that may be offered by the travel agent. However, no modification of the price can occur less than 30 days prior to departure. Price of your travel is based on a minimum of paying participants which is different for each destination. If your group does not have this minimum, it will consequently increase the cost of your trip.

1.3 Tour Supplements for Prométour Educational Tours student groups:

Our educational tours are designed for students; however, adults are welcome to join. A flat adult (aged 18 years or older) supplement of $15 per day will be charged per adult participant. A twin room supplement per night, per adult will also apply as indicated below.

Rooming is based on multiple occupancy, single beds not guaranteed unless otherwise stipulated in the program.

1.5 Administrative Fee

A one-time administrative fee may apply to your online account upon registration. This fee is non-refundable should you choose to cancel your participation.

1.6 Payments

Payments are due as per your tour payment schedule. If you cannot meet a payment deadline, please contact Prométour 2000 as soon as possible. Prométour 2000 offers several convenient payment plans and accepts Visa, MasterCard, checks, and international money orders. Your payment is not deemed completed until Prométour 2000 receives it. Specialty items such as show tickets and sporting events must be paid upon booking.

Upon acceptance of the Terms & Conditions, you acknowledge that the form of payment chosen by you will be processed according to the payment plan selected and may involve a third party. Prométour 2000 does not charge transaction fees and is not held liable for any additional transaction fees charged by your financial institution and/or credit card provider.

A reservation made after the final payment deadline is payable in full at the time of booking. Failure to pay in full before the balance deadline will result in a management fee of $75 (all land-based programs) or $150 (all programs including flights) to cover administrative costs.

A $50 fee will be charged for all unwarranted credit card chargebacks and/or bounced check payments.

1.7 Refunds

No refund will be made for any unused travel services or any portion thereof, nor is the price or value of unused travel services exchangeable for alternative services.

Your tour price generally includes a travel insurance policy premium which is deemed valid once the trip is confirmed. The first deposit includes the payment of the insurance policy premium. Insurance premiums for customers on confirmed groups are non-refundable. A trip is deemed confirmed once the minimum number of paying participants is reached and the required deposit is received by Prométour 2000. The minimum number of participants varies based on the program. The minimum number of participants is indicated on your program.

If there is an outstanding credit card chargeback, Prométour 2000 reserves the right not to issue a participant refund until the chargeback is resolved.

1.8 Payment Protection Coverage

As an active operator under the Québec Travel Agent Act, Prométour 2000 shares the coverage available under the regulations of the Travel Agent Law. The coverage, with a multi-million traveler’s assistance program, is used to reimburse the advance payments of Prométour 2000 customers. In the unlikely event of Prométour 2000 bankruptcy, insolvency or cessation of business, customer payments will be reimbursed in accordance with the law. 2. CANCELLATION AND MODIFICATION

2.1 Cancellation Made by Participant

Customers wishing to cancel their participation on a tour must complete and submit a Prométour 2000 Cancellation Form by mail, fax, or email. The administrative fee paid upon reservation and the insurance premium are non-refundable.

The cancellation date will reflect the date written on the completed and submitted Cancellation Form. Allow 5-10 business days for processing upon reception of the Cancellation Form.

For each cancelled participant, the base tour cost charged to the remaining participants may increase/decrease according to the tour price list.

If you are booked in a double/twin room and your roommate cancels his/her tour more than 45 days prior to departure, you will be responsible for paying the single occupant supplement fee.

If a traveler is absent on the outbound flight and does not provide previous notice to Prométour 2000 to help make new travel arrangements, the remaining portions of the flight will be canceled by the airline and the traveler will be responsible for purchasing a new flight ticket. Any traveler who forgoes their return flight will not be entitled to a refund.

2.2 Reinstating enrollment

Participants who have canceled and want to rejoin the tour must pay a $50 reinstatement fee, plus any difference between the old and new tour cost and any applicable late fees. Travelers must also re-purchase insurance (if applicable). Reinstatement is subject to availability and to all conditions governing late enrollments (if applicable). If no space becomes available, all original cancellation fees apply.

*For groups with less than 10 travelers or individual tickets, the minimum cancellation charge will be based on the cost of the airline ticket issued.

2.3 Cancellation Made by Third Party 

Tours sponsored and organized through a third party such as but not limited to: a school, teacher, group leader, association, club, organization are subject to a group cancellation based on the decision of the third party.

In the event of such cancellation, the Cancellation Charges stated in §2.1 above will apply. Alternatively, registered participants may have the option to continue the tour by assuming the liability and associated responsibilities such as assigning a new group leader and changing the group name. Prométour 2000 cannot be held responsible for incurred fees related to such cancellations. The price conditions apply as stated in §1.2

2.4 Cancellation or Modification Made by Prométour 2000

We reserve the right to cancel, postpone, or reschedule a tour for any external event beyond our control if we consider it could affect the safety and wellbeing of the travelers or the quality of the trip. These events can be and are not limited to: “acts of God” or force majeure, epidemics, pandemics, or other public health issues or emergencies; severe weather events or natural disasters such as but not limited to hurricanes, earthquakes, tsunamis, tornadoes, fires, floods, volcanic activity, or landslides; war (whether declared or undeclared); terrorist activities; instability in a destination location; incidents of violence, riot, sabotage, civil commotion, or nationalization; strikes or labor disputes or lockouts; government orders, sanctions, actual or potential quarantines, or other restrictions affecting travel in, to, or around a location; disruption to transportation; chemical or radioactive contamination; or any other reason that makes it actually or potentially impossible for Prométour 2000 to conduct the tour as originally contracted. In such cases our liability will be limited to the purchase price of the travel services only, and we shall not be liable for any claims, demands, losses or damages of any nature or kind whatsoever you may have by reason of our cancellation, postponement and/or modification of the travel services. Prométour 2000 reserves the right to cancel a reservation without notice, due to non-payment or due to litigation regarding payment.

2.5 Modification Made by Prométour 2000

We reserve the right to modify a tour you have purchased by substituting services, varying the itinerary, or otherwise. Furthermore, suppliers have the right to substitute other suppliers in their place with or without notice. In all cases you will receive a comparable or superior service. During local festivities, national holidays, strikes, demonstration, etc. beyond our control, access to certain facilities such as museums and restaurants, sightseeing tours, and shopping may be limited or not available. Weather conditions may cause delays, modification, or cancellation of services. Prométour 2000 cannot be held responsible in such cases. Alternatives will be offered whenever possible.

2.6 Cancellation of a tour due to a force majeure

Cancellation due to country instability and/or a pandemic/epidemic will be based on US or Canadian government issued advisories and recommendations for the destination country(s) of your tour. Prométour 2000 cannot be responsible for such cancellations.

2.7 Modification Made by Participant

Any modification may be considered as a cancellation and can result in Cancellation Charges as previously stated. Any modification while on tour will not result in any refund if services are decreased but will result in a surcharge to be paid on site if services are increased. A name change is not a modification but is a participant substitution. If Prométour 2000 is advised that any of the first, middle, or last name, date of birth, and/gender is incorrect after the final participant list has been submitted to the airline and/or insurance company – the participant will be charged applicable airline and/or insurance name change fees and a Prométour 2000 fee of $250. These charges are related to legal and security requirements and are indisputable.

2.8 Participant Substitution

We reserve the right to refuse a participant substitution. A participant wishing to transfer his/her contract to another person must submit a Prométour Cancellation Form along with the substitute participant’s pertinent information. Substitution charges are 50% of due cancellation charges not inclusive of any other airline surcharges and/or insurance premium.

3. RESPONSIBILITIES

3.1 Travel Interruption

In the event of your withdrawal from a tour after commencement, Prométour 2000 can make no refund. In case of illness or physical limitations, you must obtain a medical certificate in support of any insurance claim. Prométour 2000 makes no representation or guarantees concerning reimbursements of funds paid under any insurance claim.

3.2 Health and Capabilities

The pace of each tour varies, but in general they require participants to be in good physical and mental health. You are required to inform Prométour 2000 at the time of registration of any physical disabilities or limitations. We recommend that participants seek medical advice before departure. Prométour 2000 reserves the right to decline a participant at any time whose condition, in our opinion or in the opinion of a third-party providing services on the tour, may affect the health, safety, or tour experience of other travelers. Passengers requiring food complying with special diets should notify Prométour 2000 at the time of registration with any dietary and preparation requirements. Prométour 2000 will work with those participants who have special needs and/or food restrictions. All issues regarding food and drink, including allergies, or dietary requirements and restrictions, are the sole responsibility of the participant. If you do not notify Prométour 2000 at registration of special dietary requirements, you agree to be responsible for meeting your dietary restrictions.

3.3 Passport, Visas & Administration

The participant is responsible for obtaining all visas, passports, entry documents, health requirements, and any documents required by laws, regulations, orders, and/or requirements of the countries to be visited. This process must be completed well in advance of departure. Participants must consult appropriate consulates to determine if any visas are needed. Failure to do so may result in refusal of travel. All passengers travelling internationally are required to have a valid passport. Most countries require that the passport be valid for at least six (6) months beyond the conclusion of your trip. Names on airline tickets must be identical to the passenger’s passport. In addition to appropriate travel documents for your destinations, minor children (18-years or under) travelling to any foreign destination when not accompanied by both parents, must have an affidavit (notarized consent letter) stating:

– The child is travelling to a foreign destination with the permission of the parents/legal guardian.

– The child is travelling in someone else’s care. The affidavit must be signed by both parents and must be notarized for some destinations. If a minor child is living with only one parent, the affidavit must be signed by that parent and be accompanied by a copy of their legal custody agreement or death certificate if applicable.

It is the sole responsibility of the participant to provide proper documentation. No refunds will be made for improper documentation resulting in denied boarding or entry.

3.4 Liability

Prométour 2000 takes pride in selecting quality suppliers (i.e.: airlines, hotels, ground transport companies, etc.) Each Prométour 2000 program begins at your departure as established in your program and ends upon completion of services established in your program. Prométour 2000 acts only as an agent for these suppliers who are independent parties over which we exercise no direct control and we assume no responsibility for their acts or omissions. Prométour 2000 is not responsible for the behavior of participants on a tour – this is the sole responsibility of the group leader, participants, and chaperones. Prométour 2000, its affiliates, directors, officers, employees, teachers/group leaders, schools, associations, clubs, organizations cannot be held responsible for events beyond their control, including but not limited to: war, civil unrest, any acts of violence, force majeure, acts of God, terrorist activities, strikes, epidemics, pandemics or government restrictions. Nor are they responsible for personal injury, death, property damage, baggage and personal effect loss or theft, and in the absence of its own gross negligence or from any act or omission arising from Prométour 2000’s selection of vehicles, host families, schools, airlines, hotels, tour operators, transportation companies, sightseeing contractors or other firms, companies, agencies or individuals.

The participant understands and agrees to hold Prométour 2000 harmless from expenses and injuries incurred as a result of contracting COVID-19 or any other illness during or after a tour. The participant accepts and understands all risks of travelling during any pandemic, including but not limited to COVID-19

3.5 Travel Insurance Coverage

All tours include a non-refundable cancellation, travel protection, and emergency medical insurance package unless otherwise stipulated or not available in your country, state, or province of residence.

While this insurance policy is highly recommended, all participants may opt out of its coverage if they so choose. In order to remove the insurance premium from the packaged price Prométour 2000 requires a signed insurance waiver stating: I hereby acknowledge that Prométour 2000 made this offer of insurance in good faith and that I have made an informed decision to take out or refuse such insurance and to assume full liability for my decision.

3.6 Airlines and Airports

Participant(s) are subject to the terms and conditions of the airline, which constitutes the sole contract between an airline and passenger. Flight delays and schedule changes are the sole responsibility of the airline. Any domestic and international departure or arrival taxes, security charges, fuel surcharges, baggage fees, or any other charges imposed by airlines, airports, governments etc. are subject to change without notice due to legislation beyond our control. Prométour 2000 reserves the right to pass on said changes to each passenger. Additional tickets may be requested up to a maximum of 45 days prior to departure and may incur additional fees.

Airlines may require temperature checks and/or have other screening measures in place at the time of boarding. The participant understands and agrees to hold Prométour 2000 harmless in the event of denied boarding. Prométour 2000 cannot be held responsible for any incurred fees due to denied boarding and any costs associated to missed services.

Alternate return-date requests are limited to 10% of the total group size. It is not possible to alter your return departure-point or flight route. The deadline to submit a request for an alternate return-date is 90 days prior to departure. A $150 Prométour 2000 Service Fee will be applied for processing your request and will be upheld if you choose not to take the option we offer. You will be informed of the final cost including any applicable airline supplements before changes are made. Any additional changes will incur fees as previously mentioned.

3.7 Claims

Despite all our efforts, claims may arise, and we invite you to file your claim in writing by registered mail no later than 21 days after the event causing the claim. In the event of any dispute or proceeding, parties must submit and consent to the exclusive jurisdiction and venue of the courts of the Province of Québec, Canada.

3.8 Privacy Notice

When you enroll for a trip with Prométour 2000, you will be asked to submit personal information such as your name, address, email address, gender, phone number, date of birth, and passport number. We will share your personal information with suppliers (e.g. airline, hotel, insurance, and activity providers) only when necessary to fulfill your program requirements and reservations. We will never sell or rent your personal data to third party companies. By enrolling in our programs through our online platform, you are authorizing us to disclose to our suppliers the information required to complete the program requested and fulfill related requirements such as insurance and medical coverage.

3.9 Photo & Video Release

I hereby grant Prométour 2000 the irrevocable right and permission to use photographs and/or video recordings of me on the Prométour 2000 website and in publications, promotional flyers, educational materials, derivative works, and social media or for any other similar purpose without compensation.

I understand and agree that such photographs and/or video recordings may be placed on the Internet. I also understand and agree that I may be identified by name and/or title in print, Internet or broadcast information that might accompany the photographs and/or video recordings. I waive the right to approve the final product. I agree that all such portraits, pictures, photographs, video and audio recordings, and any reproductions thereof, and all plates, negatives, recording tape and digital files are and shall remain the property of Prométour 2000.

I hereby release, acquit and forever discharge Prométour 2000, its current and former trustees, agents, officers and employees of the above-named entities from any and all claims, demands, rights, promises, damages, and liabilities arising out of or in connection with the use or distribution of said photographs and/or video recordings, including but not limited to any and all claims for invasion of privacy, appropriation of likeness, or defamation.

I hereby warrant that I am the parent or legal guardian of the participant or I hereby warrant that I am eighteen (18) years old or more and competent to contract in my own name. This release is binding on me and my heirs, assigns and personal representatives.

4. TRAVEL ACKNOWLEDGMENT

TO:  Prométour 2000 and their affiliates, directors, officers, employees, teacher/group leaders, schools, associations, clubs, organizations.

4.1 The participant understands that the pace of each tour varies, but in general they require participants to be in good physical and mental health.

4.2 The participant understands and agrees to hold Prométour 2000 harmless from expenses and injuries incurred as a result of contracting COVID-19 or any other illness before, during, or after a tour. The participant accepts and understands all risks of travelling during any pandemic, including but not limited to COVID-19.

4.3 The participant understands that in the event of a suspected or a diagnosed COVID-19 infection, he/she will be required to separate from the group to undergo treatment and quarantine as per local health authorities protocols, which may differ from their home country. The participant also agrees that in the event of the group’s exposure to a COVID-19 infection, they may be subject to testing and quarantine, even if they are asymptomatic, as per local health protocol. Any expenses incurred by the disruption to travel dates are at the participant’s expense and unused services are non-refundable.

4.4 The participant agrees to follow local rules and recommendations aimed at facilitating contact tracing when asked to provide contact information to restaurants and businesses, as it is common practice in many parts of the world.

4.5 The participant understands that the environmental and weather conditions of the destination country(s) may be different than those in his/her country of residence.

4.6 The participant understands that the laws of the destination country(s) may be significantly different than those of his/her country of residence.

4.7 The participant understands the medical facilities in the destination country(s) may be of a different standard than that of his/her country of residence.

4.8 Each Prométour 2000 program begins at your departure as established in your program and ends upon completion of services established in your program. The participant understands that Prométour 2000 acts only as an agent for suppliers (i.e.: airlines, hotels, ground transport companies, etc.) who are independent parties over which we exercise no direct control and we assume no responsibility for their acts or omissions.

4.9 The participant understands that Prométour 2000 is not responsible for the behavior of participants on a tour – this is the sole responsibility of the group leader, participants, and chaperones.

4.10 The participant understands that Prométour 2000, its affiliates, directors, officers, employees, teachers/group leaders, schools, associations, clubs, organizations cannot be held responsible for events beyond their control, including but not limited to: war, civil unrest, any acts of violence, force majeure, acts of God, terrorist activities, strikes, epidemics, pandemics or Government restrictions. Nor are they responsible for personal injury, death, property damage, baggage and personal effect loss or theft, and in the absence of its own gross negligence or from any act or omission arising from Prométour 2000’s selection of vehicles, host families, schools, airlines, hotels, tour operators, transportation companies, sightseeing contractors or other firms, companies, agencies or individuals.

5. RELEASE OF LIABILITY, WAIVER OF CLAIMS AND INDEMNITY AGREEMENT

In consideration of Prométour 2000 allowing my participation in this trip I agree as follows:
5.1 TO WAIVE ANY AND ALL CLAIMS that I have or may have in the future against Prométour 2000, its affiliates, directors, officers, employees, teachers/group leaders, schools, associations, clubs, organizations (all of whom are hereinafter collectively referred to as “the Releasees”);

5.2 TO RELEASE THE RELEASEES from any and all liability for any loss, damage, injury, illness (including COVID-19), or any expense that I might suffer, or that my next of kin may suffer as a result of my participation on a trip due to any cause whatsoever.

5.3 I have read and understood the most current travel advisories and information of the destination country(s) that have been issued from official government sources.

5.4 This agreement shall be effective and binding upon my heirs, next of kin, executors, administrators, assigns and representatives in the event of my death or incapacity. In entering into this Agreement, I am not relying upon any oral or written representations or statements made by the Releasees other than what is set forth in this Agreement.
